Terms of Service

Please read these Terms of Service ("Terms") carefully before using the 16-Bit Hockey mobile game or the website located at 16bithockey.com (collectively, the "Service"), operated by HEAPO Solutions, LLC ("we," "our," or "us").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and HEAPO Solutions, LLC. Your use of the Service constitutes your unconditional acceptance of these Terms and any policies incorporated herein by reference, including our Privacy Policy. We reserve the right to update these Terms at any time; see Section 14 for details.

2. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are between 13 and 17 years of age, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly permit persons under 13 to use the Service. If we learn that a user is under 13, we will terminate that account and delete any associated personal information.

3. Account Registration and Security

To access most features of the Service you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your password
• Not share your account credentials with any other person
• Notify us immediately at the address in Section 15 if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may not create more than one account per person. We reserve the right to suspend or terminate duplicate accounts. Accounts registered using false or misleading information may be removed at any time.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial entertainment purposes.

You may not: (a) copy, modify, or distribute the Service or any portion of it; (b) reverse engineer, decompile, or disassemble the Service; (c) rent, lease, or sublicense the Service; (d) use the Service to develop a competing product or service; or (e) remove any proprietary notices from the Service.

5. Acceptable Use and Prohibited Conduct

You agree that you will not, and will not attempt to:

• Cheat or exploit — Use bots, scripts, macros, modified clients, or any other unauthorized means to gain an unfair advantage in the game
• Harass or abuse others — Use the Service to bully, threaten, stalk, defame, or otherwise harm other users
• Impersonate — Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Create multiple accounts — Create or use more than one account, including to circumvent a suspension or ban
• Manipulate leagues — Collude with other users to manipulate game outcomes, trade outcomes, or standings
• Distribute malware — Transmit viruses, malware, or any code designed to disrupt or damage the Service
• Unauthorized access — Attempt to access accounts, systems, or networks belonging to us or other users without authorization
• Violate laws — Use the Service for any purpose that is illegal or prohibited by these Terms

Violation of these rules may result in suspension or permanent termination of your account, at our sole discretion, without prior notice.

6. User-Generated Content

The Service allows you to create content such as team names, league names, and display names ("User Content"). You retain ownership of User Content you create, but by submitting User Content you grant us a worldwide, royalty-free, perpetual license to use, display, and moderate that content in connection with the Service.

You agree that User Content will not: (a) be obscene, hateful, or discriminatory; (b) infringe the intellectual property rights of any third party; (c) violate any applicable law or regulation; or (d) contain personal information of another person without their consent. We reserve the right to remove any User Content that violates these Terms.

7. Virtual Items and In-Game Economy

The Service includes a simulated in-game economy featuring virtual currency, players, equipment, and other virtual items (collectively, "Virtual Items"). Virtual Items have no monetary value, cannot be exchanged for real money, and cannot be transferred outside of the Service.

We may modify, suspend, or eliminate any Virtual Item at any time without notice or compensation to you. You acknowledge that you have no property right in any Virtual Item and that any accumulated Virtual Items may be lost upon account termination.

8. Intellectual Property

The Service and all content within it — including but not limited to graphics, artwork, game mechanics, audio, text, and software — are the property of HEAPO Solutions, LLC or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws. All rights not expressly granted to you under these Terms are reserved.

"16-Bit Hockey" and associated logos are trademarks of HEAPO Solutions, LLC. You may not use our trademarks without our prior written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Game simulation results — including scores, player performance, injuries, and other in-game outcomes — are determined algorithmically and are final. We make no warranty that any particular team configuration, lineup, or strategy will produce any particular result.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEAPO SOLUTIONS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED FIFTY U.S. DOLLARS ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, or behavior that harms other users or the integrity of the Service.

You may terminate your account at any time by using Settings → Delete Account within the app or by contacting us at the address in Section 15. Upon termination, your license to use the Service ends immediately and we may delete your account data in accordance with our Privacy Policy.

Sections 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 12 (Governing Law), and 13 (Dispute Resolution) survive termination.

12. Governing Law

These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict-of-law principles.

13. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at the address in Section 15 and give us 30 days to attempt to resolve the dispute informally.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (excluding claims for injunctive or other equitable relief) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration shall be conducted in Maryland or, at your election, by telephone or videoconference. The arbitrator's decision shall be final and binding.

Class Action Waiver

You and HEAPO Solutions, LLC each waive the right to a jury trial and the right to participate in any class action, class-wide arbitration, or representative proceeding. All claims must be brought on an individual basis only.

Exceptions

Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction in Maryland to prevent irreparable harm pending arbitration. Nothing in this section prevents either party from pursuing claims in a small claims court for disputes within that court's jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. For material changes we will provide advance notice via email or a prominent in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

If you do not agree to a material change, your sole remedy is to stop using the Service and delete your account before the change takes effect.
